These terms govern use of ARM Business Management Software, supplied by All-Round Marketing Ltd trading as ARM BMS, company number 15080219. By creating an account or using the service, the customer agrees to these terms.
1. The service
ARM BMS is online business-management software for contacts, work, quotations, schedules, receipts, stock, documents, reporting and related functions. Features depend on the selected plan and may develop over time.
2. Accounts and authority
You must provide accurate information, be authorised to act for the named organisation and keep sign-in details secure. Administrators control users and permissions in their workspaces. Tell us promptly about suspected unauthorised access.
3. Plans, trials and payment
The Starter plan may be available without charge. Paid features only activate after a successful payment or authorised manual activation. Prices, billing periods, renewal dates, discounts and applicable taxes are shown before purchase. Promotional codes may have plan, customer, expiry and single-use restrictions. Payment functionality is subject to the appointed payment provider’s terms once checkout is activated.
4. Customer content
The customer retains ownership of content it enters and gives us the limited permission needed to host, back up, process and transmit that content to provide the service. The customer is responsible for accuracy, permissions, lawful bases, retention choices and communications sent using its workspace.
5. Acceptable use
You must not use ARM BMS unlawfully; send spam or unlawful messages; upload malicious or infringing material; attempt to access another customer’s data; bypass plan, security or payment controls; reverse engineer protected parts of the service; or interfere with availability. We may restrict activity needed to protect users, the service or third parties.
6. Integrations
Third-party services such as Google, Apple, Microsoft, Twilio, WhatsApp and Stripe are optional. Their availability, approval processes, charges and terms are controlled by those providers. We are not responsible for a third-party service being delayed, changed or unavailable, but will take reasonable steps to keep our integration points maintained.
7. Availability and changes
We aim to provide a reliable service but do not guarantee uninterrupted access. Maintenance, security events, internet failures and provider outages may affect availability. We may update features, provided this does not materially remove paid core functionality without reasonable notice.
8. Suspension and termination
Customers may stop using the service and can request account closure. We may suspend or terminate access for non-payment, serious misuse, security risk or material breach, normally after notice where it is safe and reasonable to do so. Data export or deletion requests remain subject to legal and operational retention requirements.
9. Intellectual property
ARM BMS, its software, design, branding and documentation belong to All-Round Marketing Ltd or its licensors. No ownership rights transfer to the customer. Feedback may be used to improve the service without disclosing confidential customer information.
10. Liability
Nothing excludes liability that cannot legally be excluded, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation. Subject to that, ARM BMS is not liable for indirect or consequential loss, lost profit or loss caused by customer misuse, inaccurate customer content or third-party services. Any aggregate contractual liability is limited to fees paid for the affected service during the preceding 12 months, or £100 for a free account.
11. General
If a provision is unenforceable, the remainder continues. Delay in enforcing a right does not waive it. These terms and the referenced policies form the agreement unless a signed contract says otherwise. English law applies and the courts of England and Wales have jurisdiction.
